Madrid, Jul 31 (EFE) .- Fuenlabrada declares himself “ready” to play the match against Deportivo when indicated, once it is known this Friday that the RFEF Competition Committee has rejected the loss of the Madrid team the match of day 42 of LaLiga SmartBank suspended by the positives of coronavirus in the fuenlabreña staff.
“The Competition Committee – the Fuenlabrada points out – has rejected the request for precautionary measures proposed by the Examining Judge, as it did not appreciate the existence of sufficient indications. Therefore, it does not give the match on day 42 against Deportivo for losing to the CF Fuenlabrada “.
“Likewise,” added the club statement, “it considers that a measure such as the one proposed would not respect the principles of proportionality, reasonableness and less onerousness.”
Consequently, “the club is pending the indications of the institutions prepared to dispute the match when indicated.”
The Fuenlabrada, through two briefs, requested that the proposed precautionary measure be rejected in its entirety; and Numancia also asked that the precautionary measure not be adopted.
In the resolution, to which EFE has had access, it is established that LaLiga has presented a brief of allegations considering, among its requests, that it would be appropriate to return the actions to the instructor so that he could formulate a new proposal for the adoption of precautionary measures
Competition understands that “the adoption of the requested measure would prejudge the merits of the matter at a time when not all the evidence and allegations necessary to rule with certainty on the facts produced are available” and if these “would be subsumed in any typified offense in the RFEF Disciplinary Code “.
